FACT:
Certain state administered leaking underground storage tank ("LUST") funds do
not have sufficient revenues to reimburse claims in a timely manner. The
result is that UST owner's (known as "Responsible Parties" or "RP's") or their environmental consultants end up waiting months or even years for
reimbursement. Delays in
reimbursement can cause cash flow problems for RP's, thereby contributing to a slowdown in the pace of LUST
clean up's. The failure to clean up contaiminated sites in a timely manner can result in
increased public health risks and higheer costs to the state sponsored cleanup fund.
